These Terms and Conditions govern your use of the ÉCLAT NOIR website and your purchases from us. By placing an order, you agree to be bound by these terms. Please read them carefully.
You must be at least 18 years old to purchase goods from ÉCLAT NOIR. You are responsible for maintaining the confidentiality of your account details and for all activities under your account.
All products are subject to availability. Product images and descriptions are provided for guidance; minor variations may occur due to the artisanal nature of our goods.
Prices are shown in GBP and include VAT where applicable. We take payment using secure payment providers. Your order is accepted once payment is successfully authorised and we have confirmed your order.
When you place an order, you will receive an acknowledgement email. This is not acceptance of your order. A contract is formed when we dispatch the goods and send a dispatch confirmation.
We will deliver to the address provided at checkout. Delivery times and charges will be shown at checkout. Any delivery estimates are not guaranteed. Risk in the goods passes on delivery.
If you are a UK consumer, you have a statutory right to cancel most online purchases under the Consumer Contracts Regulations 2013 within 14 days of delivery, without giving any reason. To exercise this right, you must inform us within the 14-day period and return the goods within a further 14 days in original condition. You are responsible for the cost of returning items unless they are faulty or misdescribed.
Your rights under the Consumer Rights Act 2015 also apply: items must be as described, of satisfactory quality, and fit for purpose. If goods are faulty, you may be entitled to a repair, replacement, or refund depending on the circumstances.
Once we receive your return, we will process refunds within 14 days to your original payment method. We may deduct amounts if goods show signs of unreasonable handling.

Nothing in these terms limits or excludes liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be limited or excluded under UK law. Subject to the foregoing, ÉCLAT NOIR is not responsible for indirect or consequential losses arising from your use of the website or purchase of goods.
These terms are governed by the laws of England and Wales. The courts of England and Wales shall have non-exclusive jurisdiction in relation to any disputes.
